Terms of Use

These terms are an agreement between you and Televizyon Lakay (“we”, “us”). They apply to this website and to the Televizyon Lakay apps for iOS, iPadOS, tvOS and Android. By using any of them, you agree to what follows. If you don't agree, please stop using the service.

1. What This Service Is

Televizyon Lakay is a free directory and player that links to and embeds publicly available live streams of Haitian radio stations and TV channels. We don't host, produce, own, or control the broadcast content itself — we provide a convenient way to find and play streams that broadcasters already make publicly available online.

2. Minimum Age

You must be at least 13 years old to create an account. This is why we ask for your date of birth when you sign up. If you are under 18, you may use the service only with the involvement and consent of a parent or legal guardian, who agrees to these terms on your behalf. If we learn that an account belongs to a child under 13, we will delete it.

3. Your Account

An account is optional — you can listen and watch without one. If you create one, you agree to give accurate information, to keep your password to yourself, and to tell us promptly if you think someone else has got into your account. You are responsible for what happens under your account. Accounts are handled by Google Firebase Authentication; we never see or store your password.

You can delete your account at any time. See Account & Data Deletion.

4. No Warranty on Streams

Stream availability, quality and content are entirely controlled by the original broadcasters, not by us. We make no guarantee that any given station or channel will be available at any given time, and we are not responsible for anything broadcast by a third-party station or channel listed here. The service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows.

5. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost data or lost profits. This is a free service; nothing in these terms is intended to exclude liability that cannot lawfully be excluded.

6. Acceptable Use

You agree to use this service for personal, non-commercial listening and viewing. You agree not to:

• restream, rebroadcast, record or redistribute any stream you reach through the service;
• scrape, crawl or bulk-download the site, or extract our stream URLs for use elsewhere;
• circumvent, disable or interfere with any security, access-control or geographic restriction;
• use bots, scripts or automated tools against the service, or attempt to disrupt or overload it;
• reverse-engineer, decompile or tamper with our apps;
• use the service in any way that breaks applicable law.

7. Geographic Availability

Rights to broadcast content differ from country to country. Some channels are not available in every territory, and access from certain regions, or through VPNs, proxies and data-centre connections, may be blocked. This is a licensing requirement, not a fault. Attempting to defeat these restrictions is a breach of these terms.

8. Mobile Applications

The following applies specifically to our iOS, iPadOS, tvOS and Android apps.

Licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial use. You get no ownership of the app, and all rights not expressly granted are reserved.

App store rules. Your use is also subject to the rules of the store you installed from — Apple's App Store Terms or the Google Play Terms of Service. If those rules conflict with these terms in relation to the app, theirs prevail.

Apple. Where you obtained the app from the App Store, you acknowledge that these terms are between you and us and not with Apple; that Apple has no obligation to provide support for the app; that Apple is not responsible for any claim about the app, including product-liability, legal-compliance or intellectual-property claims; and that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Google. Where you obtained the app from Google Play, you acknowledge that these terms are between you and us and not with Google, and that Google is not responsible for the app or its content.

Updates. We may issue updates, and may change or discontinue app features at any time. Some updates may be required for the app to keep working.

Notifications. If you allow push notifications, we may send occasional messages about new channels or service changes. You can turn them off in your device settings at any time.

Network and device costs. Streaming uses significant mobile data. Any data charges, roaming charges or device costs are yours, not ours.

Privacy. App data handling is described in our Mobile App Privacy Policy.

9. Premium Subscriptions

Most of Televizyon Lakay is free and stays free. Nago News, Nago Sport 1, Nago Music and Nago Gospel need no account and no payment. Premium is optional, and it unlocks every channel including Nago Sport 2, removes advertising, and adds alarms, the sleep timer and the full song history.

Auto-renewing subscription. Premium is sold as an auto-renewable subscription through the Apple App Store. The exact title, length and price are shown in the app before you buy, in your own currency. Payment is charged to your Apple Account when you confirm the purchase.

It renews by itself. The subscription renews automatically unless you turn auto-renewal off at least 24 hours before the end of the current period. Your account is charged for the next period within the 24 hours before the current one ends. A free trial or introductory offer, where one is given, ends the same way — if you do not cancel before it expires, the paid period begins.

Cancelling. You can manage or cancel at any time in your Apple Account settings on your device: Settings → your name → Subscriptions. We cannot cancel it for you, because we never hold the payment method. Deleting the app does not cancel a subscription, and neither does deleting your Televizyon Lakay account — cancel through Apple first, or the renewal will still be charged. Access continues until the end of the period already paid for; there is no partial refund for the unused part of a period.

Refunds. Purchases made through the App Store are handled by Apple, so refund requests go to Apple rather than to us, at reportaproblem.apple.com. Where the law where you live gives you a right to cancel or a refund, that right applies and nothing here removes it.

Using Premium on a computer. A subscription belongs to your Televizyon Lakay account, not just to the phone that bought it. Sign in to the app after purchasing, and the same subscription works when you sign in on televizyonlakay.com. If you never sign in, the subscription still works on that device, but we have no way to recognise it anywhere else.

Restoring. If you reinstall the app or move to a new device, use Restore Purchases on the Premium screen, or sign in to your account. One subscription unlocks one account; it cannot be shared between accounts.

Price and content changes. Prices may change. Apple will tell you before a price increase takes effect and, where required, ask you to agree before renewing. The channel line-up can change as broadcasters come and go — we do not guarantee that any particular channel will remain available for the whole of a subscription period, and Section 4 applies to Premium channels as much as to free ones.

10. Advertising

This service is supported by advertising served through Google AdSense and AdMob. Ads are what keep it free to use. Interfering with the display of advertising is a breach of these terms. See our Privacy Policy and Cookie Policy for how ad personalisation works.

11. Intellectual Property

The Televizyon Lakay name, logo, design, and the arrangement and presentation of our directory are ours. Station and channel names and logos belong to the broadcasters they identify and are used to identify those broadcasters. Nothing here grants you a licence to any content you reach through the service.

12. Copyright and Takedown

If you are a broadcaster or rights holder and believe a stream listed here shouldn't be, see our DMCA / Copyright Notice page for how to submit a takedown request. We review and act on valid requests promptly.

13. Third-Party Services and Links

The service connects you to independent broadcasters and relies on third-party providers including Google Firebase, Google Analytics and Google's advertising services. We don't control those parties, and their terms and privacy policies govern their own conduct.

14. Suspension and Termination

We may suspend or terminate access, with or without notice, if we reasonably believe these terms have been breached or that the service is being abused. You may stop using the service, and delete your account, at any time.

15. Indemnity

You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising out of your misuse of the service or your breach of these terms.

16. Governing Law

These terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules. If a provision is found unenforceable, the rest stays in force.

17. Changes

We may update these terms from time to time. We will change the date at the top when we do. Continued use after changes are posted means you accept the updated terms.
